A BILL FOR AN ACT relating to health care; to prohibit the use of powdered latex products; and to provide for rules and regulations.

Be it enacted by the people of the State of Nebraska,

    Section 1. (1) After January 1, 1999, no public health and safety provider or health care facility shall use or authorize the use of powdered latex glove products.
    (2) For purposes of this section,
    (a) health care facility means a hospital, ambulatory surgical center, dental office, physician's office, nursing home, or any facility providing services for the diagnosis, prevention, treatment, cure, or relief of a health condition, illness, injury, or disease,
    (b) powdered latex glove product means any latex glove product that contains a protein level above ten micrograms per milligram, and
    (c) public health and safety provider means any health care practitioner licensed, accredited, or certified to perform specified health care services consistent with state law or any personnel of public law enforcement agencies, fire departments, or businesses providing emergency medical services.
    (3) The Director of Health and Human Services Regulation and Licensure shall adopt and promulgate rules and regulations to carry out this section.
